Who will control your finances and make decisions on your behalf if you became incapable of doing so?


If you become unable to manage your own affairs then your next of kin would have to apply to the Court of Protection for permission to take over your affairs and to make decisions on your behalf. This can be a lengthy and expensive procedure. A lasting Power of Attorney enables you to decide now who you wish to deal with your affairs, should you become incapable of doing so. The Power of Attorney does not come into effect until the situation arises where you are unable to manage your own affairs. By obtaining the Power of Attorney now you will avoid the expense and distress of your family having to pursue a complex procedure through the Court of Protection.
