
Family disputes involving children are often the most difficult to resolve and require a high degree of expertise and a sympathetic approach to
achieve an arrangement protecting the children's well-being.
The law provides that if parents on divorce or separation can agree between them the arrangements in respect of children then the Court will not become involved.
Our team of experts will therefore at the outset, try and negotiate agreement in all respects concerning your children. If however this is not successful, then we are able to advise and represent you in any Court proceedings.
Orders which Courts commonly make are
- Residence Orders - where the Court determines with whom the children should live,
the parents being unable to agree this.
- Contact - arranging for the children to retain contact with the parent with whom they do not live.
- Parental Responsibility - where the Court considers the parents responsibilities, rather than rights, in respect of their children.
- Prohibited Steps Orders - where the Court can stop a parent doing something, such as moving out of the area with the children.
- Specific Issue Order - where the Court can require a parent to do something, for example, send a child to a specific school.
- Child Abduction - where steps can be taken by the Court, often on an emergency basis to recover children who have been abducted and to stop them from being removed from the Country.
